Terms of service

Last updated 2 November 2026. These terms apply to every Victic engagement, including the free first report. A contract we have both signed takes precedence where the two differ.

The short version
  • This is a service for businesses only. We watch the public accounts you name and send you reports.
  • The first report is free: a Basic report on up to five accounts. After that you pay in advance for the period you picked.
  • Nothing renews on its own. A monthly plan covers one month unless you ask us to invoice each month automatically, which you can stop at any time. Three and six month terms run to their end. We remind you before a plan ends.
  • Reports are yours to keep and to use with your own clients. The posts shown in them still belong to whoever published them, so you may not republish or resell that content.
  • If Instagram, Meta or our data providers stop us from delivering, we refund the unused part of your billing period. That is the most we owe for an outage.
  • AI labels and findings can be wrong. They are aids to analysis, not advice.
  • For anything else, the most we owe is what you paid us in the last twelve months.

This box is a summary. The numbered clauses below are the terms.

1. Who these terms are with

Victic is a service provided by Andrej Majer, a sole trader established in Ireland, of 11 Millbrook, Mill Lane, Carlow R93 T026, Ireland, email info@victic.eu ("we", "us"). "You" means the business or organisation that engages us.

The service is offered to businesses and organisations only, not to consumers. By requesting it you confirm that you act for a business or organisation and have the authority to accept these terms on its behalf.

2. How the agreement is made

The agreement starts when you send us a request, through the form on this site or by email, and we confirm it in writing. A paid engagement starts when you confirm a plan in writing or pay the first invoice. Email counts as writing throughout these terms.

The agreement consists of your order (the plan, the accounts and the reporting rhythm we have confirmed to you) and these terms. If they conflict, the order wins. Your own purchasing terms, or terms printed on a purchase order, do not apply unless we have signed them.

3. What we provide

We capture publicly available content from the social media accounts in your order, keep it for a limited time, analyse it, and deliver it to you as periodic reports, together with access to the captured posts behind them. What a given engagement includes is what your order describes. This website describes the service as it stands today and is not a promise of any feature that your order does not name.

We may improve or change how the service works, including our methods, our suppliers and the design of the reports, as long as the service you have paid for does not get materially worse.

4. The free first report

The first report is free, with no obligation to continue. It is a report on the Basic Competition Monitoring plan, covering up to five accounts over a capture period of one or two weeks, as agreed when capture starts, and it is the same report a Basic client receives. You may keep and use it whether or not you buy anything. We may decline a request for a free report, and we offer one per business.

After the free report, the reporting rhythm is the one in your order: monthly, every two weeks or weekly. Capture runs every day in every case. The rhythm sets how often a report is produced, not how often we look.

5. Fees and payment

The fees, the billing period and the reporting rhythm are those in your order, based on the prices on this site on the day we confirm it. Fees are invoiced in advance at the start of each billing period, and each invoice is due within fourteen days of its date.

Fees are stated without VAT. We are not currently registered for VAT and do not charge it. If your business is established in another EU member state, the service is supplied where you are established and you account for any VAT due there under the reverse charge. If we become registered for VAT, we will tell you before it affects your fees, and VAT will then be added where the law requires it.

If an invoice is not paid on time, we may charge interest and compensation under the European Communities (Late Payment in Commercial Transactions) Regulations 2012. If it is still unpaid fourteen days after we have reminded you, we may pause the service until it is paid. A pause does not move the end of your term.

A billing period that has started is not refundable, except where clause 6 or clause 12 says otherwise. If we change our prices, the new price applies to you only from the start of the next billing period after we have told you, and at least thirty days after we have told you.

6. Term, renewal and ending the service

Monthly plans cover one month and end at its close, and nothing further is invoiced. If you ask us to, we invoice automatically for each following month until you tell us to stop by writing to info@victic.eu; the plan then ends at the close of the month already paid for.

Three and six month terms run for the full term you chose, in exchange for the lower price, and end at its close. Nothing renews or continues on its own. Before a plan or term ends, we tell you and offer to extend it; if you accept, the new period starts the day after the old one ends, so capture continues without a gap.

We can end an engagement on thirty days' written notice. If we do, we refund any fees you have paid for the time after it ends. Either of us may end the agreement at once if the other commits a material breach and does not put it right within fourteen days of being asked to, and we may end it at once if an invoice is more than thirty days overdue.

When the engagement ends, we stop capturing. Everything already delivered to you stays yours under clause 8. On request made before the end date, we will provide a final data bundle of what was captured up to that date. What we keep after that, and for how long, is set out in the privacy notice.

7. The accounts you ask us to watch

You choose the accounts from business, brand, organisation or public body accounts, and from the public accounts of political parties and of politicians acting in their public role. You may not ask us to watch the personal account of a private individual, or an account whose content by its nature reveals the health, religious or philosophical beliefs, trade union membership, sex life or sexual orientation of the people shown. Political parties and politicians are not affected by that limit: they publish their political views to the public themselves, and we analyse that communication, never the views of the people shown with them. If you include your own accounts, you confirm you are entitled to have them analysed.

We may decline or stop watching any account that in our reasonable view falls outside this clause, or that is the subject of an objection we have upheld. We will tell you when that happens, and we will not charge for an account we have stopped watching.

8. What you may do with what we deliver

The reports, and the analysis, scores and findings in them, are yours to use inside your business and with your own clients, including under your own branding. That right does not end when the engagement does.

The posts and stories shown in the reports, the live views and the data bundles are the work of whoever published them, and they come to you as the evidence behind our findings. Our deliverables give you no rights in that content. In particular, you may not:

  • publish that content, or sell, license or pass it on to anyone outside your business and the clients the reports are made for. Showing an individual post inside your own analysis and presentations, with its source named, is fine to the extent the law allows you to quote it;
  • use the deliverables to identify, profile, contact or take decisions about any individual who appears in or is mentioned by the content, or combine them with other data for that purpose;
  • use the deliverables to train or fine-tune an AI model, or to build a dataset for sale or for anyone else's use;
  • resell the service itself, or give anyone outside your business access to the live views and workspaces we share with you, other than your own clients for whom the reports are made.

You delete downloaded data bundles once you no longer need them for your own benchmarking and planning, and in any case within six months of receiving them. If we tell you that we have removed content after an objection, you delete it from the copies you hold within thirty days.

9. What stays ours

We keep all rights in our software, methods, taxonomies, prompts, report designs and the underlying systems, and nothing in these terms transfers them. If you send us suggestions or feedback, we may use them freely and without payment.

10. Data protection, and other clients

Captured content can contain personal data. You and we each act as an independent controller of it: we decide how it is captured, kept, analysed and deleted, and you decide what you do with what we deliver. Our privacy notice explains our side. You are responsible for your own use of the deliverables under data protection law, and you tell us within five business days if you receive a request or complaint that concerns our processing.

If you give us personal data of your own, such as contact lists or access to a non-public account, we process it only on your instructions as your processor, and we will sign a data processing agreement with you on request.

The service is not exclusive. Public content we capture, and the labels, scores and findings we derive from it, may also inform the reports we prepare for other clients, including businesses in your market. What never passes to another client is anything that is yours: your confidential information, your reports, the fact that you are a client and which accounts you asked us to watch.

11. Confidentiality

We treat the fact of your engagement, the accounts you have asked us to watch and anything you tell us about your business as confidential. We will not name you as a client, or show your reports to anyone, without your permission. That applies to this website as much as to a sales conversation.

You treat as confidential anything non-public you learn about how our service works, and the prices and terms we agree with you where they differ from this site.

12. Platforms and providers outside our control

The service depends on platforms and data providers we do not control, above all Instagram and its owner Meta. Any of them can change its rules, limit or block access, or stop working, at any time and without warning, and that can prevent us from delivering the service as described. We have no control over these events, and we are not liable for any loss they cause.

When an event like this affects your service, we tell you as soon as we can. If we cannot deliver the service reliably and on its schedule, you or we may end the engagement, and we refund the fee for the days left in the current billing period, never more than the fee you paid for that period. That refund is the only remedy for such an interruption. The free first report has no fee, so nothing is refunded for it.

Reports include automated classification, descriptions and written findings produced with the help of AI models. They are aids to analysis, they can be wrong, and they are not professional advice. Decisions you take on the strength of a report are yours.

Beyond what these terms say, we give no other promise about the service, and any term the law would otherwise imply is excluded to the extent the law allows.

13. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, neither of us is liable to the other for loss of profit, revenue, business, goodwill or anticipated savings, for loss or corruption of data, or for any indirect or consequential loss. Our total liability arising out of or in connection with the agreement, in contract, negligence or otherwise, is limited to the fees you paid us in the twelve months before the event that gave rise to the claim, or EUR 100 if that is more. Clause 12 sets the only remedy for the interruptions it describes.

A claim must be notified to the other party in writing within one year of the day the claiming party became aware of it.

14. Your responsibility to us

You will cover our reasonable costs and losses, including legal costs, arising from a claim by someone else that results from your use of the deliverables outside clause 8, from an account you asked us to watch in breach of clause 7, or from your breach of data protection law.

15. Use of the service

You may not use the service or its output to harass, impersonate or target an individual, to support unlawful discrimination, or in a way that breaks the law of any place where you operate. We may pause or end the service if you do, and clause 6 applies to any fees.

16. Events outside our control

Neither of us is responsible for a delay or failure caused by events outside our reasonable control, such as a platform blocking access, an outage at a supplier, or a natural or public emergency. The affected party tells the other promptly. If such an event stops the service for more than thirty days, either of us may end the agreement, and unused prepaid fees are refunded.

17. Changes to these terms

We may update these terms. For an engagement already running, a change takes effect from the start of the next billing period that begins at least fourteen days after we have told you. If a change is materially to your disadvantage, you may end the engagement before it takes effect, without notice and without paying for the rest of a term. Earlier versions are available on request.

18. General

  • We may use suppliers and subcontractors to provide the service, and we remain responsible for them.
  • You may not transfer the agreement without our written consent. We may transfer it to a company or business that takes over the Victic service, and we will tell you if we do; your rights under these terms do not change as a result.
  • The agreement is the whole agreement between us about the service and replaces anything said or written before it. Neither of us relies on any statement not set out in it.
  • If a court finds part of these terms unenforceable, the rest stays in force, and the part is read as narrowly as needed to make it enforceable.
  • Not enforcing a right straight away does not mean giving it up.
  • Notices are sent by email to the address each of us uses for the engagement; ours is info@victic.eu.
  • No one other than you and us has any right under the agreement.

19. Law and courts

These terms, and any dispute about them or the service, are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction.
